Advertsing law?



my friend had her sons photo taken professionally and the person who took them never got back to her when he said her would.
she forgot about it and a few months later found a leaflet with her son on that the photographer had used for advertising and i just found it on his site on the internet!
is he allowed to do this without her permission?

simply put NO but are you sure this as happened is it because a similar case recently in the news, it seems funny two cases in such a short time.
anyway I have answered the question no they cannot do this as you well know already

To my knowledge, any photographs taken of you need YOUR permission to be used in any kind of advertising.
No, if he wanted to use it for advertising he should have got her son to sign a model release form which allows for the photographer to use the photo
No its not legal, you can sue him for that because he has put it on the net without your permission. You could have him for Paedofilia
No I don't think he is, unless she signed a disclosure. he is being a bit cheeky really, I would look into it, she may be able to claim some money from him.
