Boss being a jerk about my clocking in/out?



I work at a hotel, and we have a time pilot system at work that you have to punch in/out with to clock with. Recently, my boss has told me that I need to take a half hour break every five hrs. (by law because I'm 17.) that I need to clock out for. Last week, I forgot to clock in, and he sent me an email saying things like

quote: "You need to figure this out, because I'm not going to fix anymore of YOUR mistakes. If you forget to clock in, you'll be losing hours. Now get it RIGHT."

Today I forgot to clock back in after my break.. again.. and that means if I tell my boss he'll get pissed and not pay me for it.
My boss knows that I'm under a lot of pressure, as I'm 17, going to school, working full time at the hotel, as well as fixing computers and selling art in a gallery. He'd just tell me that it's my problem and that I'm at fault. Isn't there a law about an employer HAVING to pay his employees for time? I'm really struggling here. What should I do?

Tough situation. Your boss obviously feels that any mistakes on the clock in/out policy simply make more work for him/her to do, in a job that it sounds like they don't want to be there in the first place.

By law, if you work, you must get paid. Period. However, if you don't clock in/out, you can't supply any written record of proof. Plus, it would be far more difficult to take them to small claims court to get them to pay you (not to mention take more time than it'd be worth) to get them to pay you.

My honest advice to you is to find a way to remind yourself. Do you have an alarm system on your cell phone? Can you set a reminder on your watch maybe? This way when you go into work, you can set an alarm at 5 hours, then 5:30, then 10 hours, 10:30, etc. This way when you hear the alarm, you can clock in/out on time.

Also, ask him if there's a way you can fix "your own mess" (as s/he will see it). Changes to your time card will probably require some form of authentication, so see if you can talk with another manager who doesn't mind helping you out. Some one in staff - accounting manager, etc.

Yes he has to pay you and there should be a time adjustment sheet that you should fill out when you forget to clock in or out from break. Use your cell phone as an alarm to tell you when to clock back in. If you're having more problems, either find another job or call labor department. Call 411 for their number.

Legally, he has to pay you for time you work, but you have to be able to prove that you worked it! If you dont use the time clock, you cant prove it or force him to pay you for it. You might give yourself a reminder, for example, set the alarm on your watch and when it goes off, use that as your signal to clock back in. It wont take long before the alarm will trigger you to use the time clock.
