If they are photos taken of MYSELF, do i not have the RIGHT to demand owning them? not confiscation?


ok so there are photos taken of ME. do i, the subject of the photography, have the right to OWN the photo as well as the owner? i know i cannot confiscate them, but can i own them? not for commercial use.
and this isn't a business and no model release form was signed...
but basically someone i know took photos of us, and won't give them to me...

It is illegal to take a photo without the consent of the person being photographed, or if a minor then the guardians consent.

So if the person taking the picture had your consent to take the picture than I would say no, they do not have to give it to you.

If they did not have your consent then, they broke the law and can be prosecuted.

Ever go to a theme park? There is a sign outside the gates that says that by entering the park you are giving consent to be photographed without reimbursement and the pictures can be used in advertising or other.

Like any artist the photographer has the right to the photos.

The copyright belongs to the person who took the photograph.


But what about Paparazzi???
