How can i get out of a speeding fine that i don't think was me...?


Got a speeding fine, haven't been driving the car myself and I'm sure it was one of the people that came to test drive my car before purchasing.
How do I get out of it, seeming I don't know exactly who it was driving my car as I don't keep a record of every person that test drove my car, and how could I nominate who the driver is if i don't know, even if i get the images from the camera that prove it wasn't me, who can i say it was if i don't know there details?

as im aware i'll get penalised if I dont nominate a driver at the time etc...

i must say you all a very unhelpful bunch of know it alls, of course i went with them on the test drive, i don't have any telephone records as it was on my mobile which i have since lost, do you expect me to keep a record of who drove my car 3 weeks after i sold it, for those of you that do that, i would say to get a life perhaps?

In my state, if the photo doesn't match the owner of the vehicle, the citation is dismissed. No other questions asked.

Same if the photo doesn't show enough detail to identify the driver.

It may be different for your state. I would call the court and ask them.

Basically if you cant identify a driver then you are to say the least irresponsible to let unknown unnamed persons test drive your car didn't you check if they had a licence or insurance .What if they drove off and didn't come back?Basically the law is saying you are the person who is responsible for the car and should know who the driver is and that they are legally qualified to drive it.If you are served with a notice to name the driver 'Don't know' wont cut it or everyone would do that.

Obtain the photo, and hope the driver is visible. If you can show that it wasn't you, you have a defense. If not, then you don't.

surely the photo should be enough proof that you werent the one behind the wheel. id speak to a lawyer let him see the pic and see if he can stop you from getting penalised, good luck

Payoff the cop, I mean the judge, I mean get an attorney.

1.Camera tickets are issued to the registered owner.
2.You, as the owner are responsible for the ticket.
3.You, as the owner are supposed to know who is driving your car.
4.If you do not know who was driving , see number 2.
Sorry, but maybe you should keep better track of who drives your car. The law makes you ultimately responsible. The court could care less who was really driving. Thats up to you to find out. Even if you knew, you would still have to pay and then get the person who was driving to reimburse you.

The photos usually do not show enough detail to ID the driver. Even if they did, the court would still say...great, you pay up and then you go after the driver.

Same thing with parking tickets..you own the car, your problem ID'ing who was driving.

Did you go on the test drive with all these people who came along and drove your car or did you just blindly hand over the keys to a perfect stranger to go for a spin?

What would you have done if they had not returned your car? You had no name, no telephone number or any way of identifying the thief to the police other than the car they might have arrived in, which may well have been stolen too.

Did you check their insurance? Permitting someone to drive your car who has no insurance is also an offence. If you had you would have seen their name on the certificate and could have recorded it then.

What if they had run someone over or commited a crime with the car?

You either acted very irresponsibly in allowing the above scenario to take place or you went along on the test drives and should really have known if the driver was given a speeding ticket or not.

The courts hear excuses like this all the time. I assume you have proof that the car was up for sale BEFORE the date of the offence? An Autotrader printout or whatever will help prove what you are claiming.

What about mobile phone records between you and the potential purchasers? The offence must have been within 14 days of the notice arriving otherwise it is invalid.

Frankly, it is your responsibility to know who is driving your car at any given time. I don't think that blaming your total lack of organisational skills will win you many admirers in the magistrates court.

That is of course providing that your account is true and NOT fabricated in an attempt to escape punishment for your own offence - which is what it sounds like.

Sure I won't get best answer fo this response but I thought you might at least appreciate the honesty!
