Can you sue someone for giving out your picture without permission? |
This person is a professional photographer that was attending a wedding as a guest, but not hired as a photographer. She snapped pictures without the bride and grooms permission. She now wants to make copies of the pictures and give them to estranged family members. She does not have permission to do so.Can this person be sued for giving out a picture to people without permission? Please point me to a website with this information if possible. The pictures were taken in the public sphere and by inviting the photographer to the event you invited them into the privacy of your wedding and wiilingly and knowingly let them take pictures of you and your guests without giving instructions to them not to use them or give them out. The same would be true if you were on a patio at a restaurant or on the streets people can take your picture and use it how they wish. However if she i selling the picture for more than what it costs to print, you may be entitled to royalty payments however considering the event, the payments would not be worth the court costs to do so. Certain circumstances of invasion of privacy might be heard in a court, like in the case of a peeping tom taking explicit photographs. No court however will find this situation to be an Invasion of Privacy as the person taking the picture was there legally and not prohibited from taking the pictures in the first place.
