Copyrights and "hospitality" photos...? |
If a photo was taken of a family member with a race car driver, and they provide you with the web site to find it in the future. They are hospitality photos taken & the only way to get them was to go to the site. You can't buy them anywhere and there is not photographer contact information. Being a photographer, I researched the web site to see if there were any restrictions, they even HELP you to copy, save, distribute the photo. There is NO contact information to get photo release rights so I am just looking for professional opinions. Wal*Mart said they couldn't give me the photo (even though they printed it & showshowed it to me (because of a watermark from the "photographer" which they confused as drivers signature and logo). There is no (c) for photographer, NO photographer credit or anything on the web site or linked pages ANYWHERE. Any info would be great! The site seems to be set up to help you print low resolution versions of the hospitality photos. They are implying that it is OK for you to make your own prints. It is likely that the photographer was under a 'work for hire' arrangement so that NASCAR owns the copyrights. However, under US copyright law, implied rights do not protect a company such as WalMart from copyright infringement, and you will likely never convince them to make prints for you. Your best bet is to make prints yourself and be satisfied. You could contact customer relations at NASCAR and see if they will help you obtain higher resolution prints. Don't be surprised or upset if they want to charge you for them, After all NASCAR is a commercial enterprise, in the business to make money. I wanted a certaain photo and filled out the form pitchured and entered my credit card . I was told it would be four to six weeks to recieve it. an 8x10 ran me forty bucks. I had a lot of homework to get that far and only stumbled onto it by accident. Mine was a historical person they had in their archives. Many photo's before 1950 don't have copyrights. good luck. :-}) |
