A local photographer wants to use my 2 year old son's picture on his website and company cards.? |
We recently attended a wedding and the photographer took several pictures of our family, one of which was a picture of my 2 year old boy. He contacted us yesterday and commented how photogenic my son was and would we allow him to use the picture on his website and company cards? I would like to ask what deal we should cut with this photographer? Check out his backround first! Make sure he's not a weirdo! none. You do not know in what context he is using the photos do you? And if you want to move ahead, be sure to get something in writing that states the photos, and negatives remain youe sole property, to be returned to you. Monitarliy, I think the going rate is 300.00 a photo, but check with a lawyer first, this is the best bet. Do not turn over all rights to those photos to him. I wouldn't let him - sounds dodgy. A pic of a bride and groom yes, or a group shot or something But he wants a pic of your 2yr old!? Don't do it! Investigate this business to see if it is legitimate. You never know where your son's photo could end up. Seek legal advice about a contract that states exactly how the image will be used. As far as I understand it, he owns the copyright as he took the picture so he's not obliged to pay you anything, though he does need your consent. Be proud you have a beautiful son. Sign a release that compensates your son for $100 for the first 5,000 cards and $25 for each 5,000 cards thereafter for two years. The website photo could be as much as $50 for one years usage, renewable on a year to year basis for another $50. While this may not seem like a lot of money, it is enough to start a school fund for your child. This should be a good starting point for negotiations. DigiPro |
