Copyrights of Photo... of me?

I am professional athlete. At a competition a year ago there was an action famous photo taken of me. Since then this photo has become an "icon" of the sporting event. I never received any royalties for this photo. I never complained/said anything. I know the copyright is automatic of the photographer.

However I would like to create and promote a motivation poster with this photo. Do I have any rights to use/distribute this digital photo (since I am the person in it?). Can I register rights anywhere?

Sorry, but no. The photographer owns the copyright to the picture outright, and not even you can use it without his permission.

Under 'normal' circumstances the subject of a photo that is used commercially is entitled to a modeling fee. BUT... without opening a book and checking, I'm virtually certain that the 'public interest' or 'newsworthy' exception includes photo's of athletes at sporting events.

Either way, though, you'll need the photographers permission to use his picture in the poster you plan.

No one is supposed to use a photo for something without your consent. If you never said yes or no it doesn't have your consent to be used in anything. If you have a problem you should try to contact the photographer. Most likely you will be able to use the picture unless he wants legal action taking against him
