Question about contracts and court? |
If a small business owner did not receive a signed contract at the time of service but decided to go ahead with the service. Produce no physical products but a link to see the finished product (which was very unsatisfactory - its photography) and the other person decided to cancel a deposit for a package (that the customer will no longer be needing because of firing the photographer)but turned around and sent a check for services rendered. Could that customer be taken to court? Quite a few people have told me no but I just wanted the wonderful people of yahoo to answer my question as well The question doesn't give enough information to come up with an accurate answer. There ordinarily is no bar to enforcing a verbal contract. However, it's not clear from your question what the contract was, what work was done, and whether the check sent was a partial payment or a termination payment of some kind. Usually no written contract...no breach. Sending a check could be construed as ratifying a verbal contract. |
