Can I sue a photographer for putting horribly distorted photos of me on to the Internet?


I was dancing at a club for a charity event. A professional photographer was taking photos. Four days later, I saw the photos. They were distorted, ugly and upsetting. For example, my body was morphed to look like I had 4 breasts, and one eye was smeared down my face etc. Another photo was shot on an angle that looked up my skirt. When I saw them, I went nuts. I'm still upset. Are there laws protecting me from this sort of thing?

Ask him politely to remove the photos or you will have to consult with a lawyer. You have not signed a release to give him permission to publish the photos. If he tells you that he is within his rights to take pictures of you without your consent at a public event and do whatever he feels like with them then

He still has to have a release.

And while you're at it, SUE THE CLUB, THE OWNER, AND THE CHARITY.

No. That's why celebs get so upset about paparazzi - if you're at a public event,/place or the photographer has been invited to the event - the images belong to the photographer not you.

If the photographer is being paid, he will have a contract with whoever is paying him, stating what can be done with the images.

Talk to the management of the club or the charity to see what was agreed to.

In lieu of any agreement, the photographer owns the images and can do what he or she wants with them.

As to the morphed photo's, no - the photographer owns the copyright and can do with them what he chooses.

The "upskirt" picture, however, may be a different matter. It depends a lot on your pose at the time.

If you are sitting in such a manner that someone can look - or photograph - up your skirt from a normal position, it's legal. If the only way to see up your skirt was to get on the floor or something such, then you may be able to sue civilly under the legal theory that, even though you were in a public place, you had a "reasonable expectation of privacy" inside your skirt.

Talk to the photographer. If he refuses, go to the charity. Other than that there is not much you can do
