Camera shop in vegas lost my photos.can i sue.small print in shop says i cant? |
i took my digital camera chip in for processing in a camera shop in las vegas. i went back 30 mins latter and the shop told me they have given the chip and photos to another customer.i have waited 4 weeks to see if the other customer would bring my photos bac.but they havnt.the small print in the shop says they are not responsiable for loss.can i sue them for negligence.these photos where of a holiday of a lifetime costing over 拢4000.if i can sue how do i do it in america. wiv me in england?. I'm sorry but you can't sue them because of the disclaimer,it won't even make it to court. All photo developing places have that disclaimer to protect their business and because it's a sensitive customer issue if anything does happen people (understandable) get angry and want to sue for thousands of dollars. But you are entitled to another memory card of the same value. I work in a photo lab and mistakes do happen. We have digital order kiosks and insist every customer use them for digital orders that way we don't touch the memory cards. sorry 'bout your luck in Vegas Well, unfortunately they probably have a notice somewhere that states that they are not responsible for lost pictures (even though they should be). suing someone costs a lot of money. suing and winning means you establish a monetary value to your loss. i think in this case you would spend a lot of money and get little in return even if you "won". bad luck. (my advice is a bit late, but next time, back up to your hard drive.) No, you can not sue them. I worked for a developer and the most you can get out of them is a replacement roll of film. |
