Should I sue my photographer? |
My wedding photographer says that the pictures of my ceremony didn't turn out, that they were too dark b/c she had to go to the balcony of our church to get pictures since our pastor waived her hands and said no to her at the start of the ceremony. Our pastor said this was b/c she was using flash, and she was told there was to be no flash in the church. If the photog would have turned the flash off and took pics from the lower level they would have turned out! Plus we have video of her taking pictures pre-ceremony 5ft away from people (with flash!) and they aren't included on the CD of pictures she gave us, that's supposed to have every picture she took on it. I have emailed her 3 times asking her to give us the pics, and I sent her a letter stating we wanted every single picture, even the ones that are too dark. I don't want money, maybe a refund but really I just want my pictures! If I sue her could I just sue for my pics? Or could I only sue for a refund? You can sue in the Small Claims Court for up to the maximum allowed in your state. Send her a finally letter with return receipt requested and hold on to the receipt for use with the Small Claims Court. How will you show the mediator in Small Claims Court the video where the photog is seen taking photos indoors? Print out the three emails you sent her and hold on to them for when you do go to Small Claims Court to show the mediator or judge. Do you know if she was shooting film or digital? If she was shooting digital, she could have changed the ISO on the camera and taken the photos. Or, if she had done her homework and gone to the church at few days or a week before to look around, she could have determined what film to use (ISO 400 or ISO 800 for low light situations). Either way, I think she has to give you a better answer, and you are in your right to complain since she did not do her "homework" to scout the site of the wedding ceremony and to plan for unexpected situations, like the lack of flash use; that was HER responsibility, not yours. Alternatively, send me an email and include a working email so that I can respond to you in more details. This is one reason I always discourage amateurs from trying to do a professional's job regardless of how talented and self-assured they may feel. They have no idea the legal obligations they may have to answer to... that's why I also tell every up and coming would-be photographer to work along an established professional, to do an apprenticeship, and learn, learn and learn... Good luck and best wishes. You are a big cry baby. I think you could sue for your money back, and costs of going back (tux rental, church rental etc.) to have pictures done with a real photographer. This photographer did not do her job, and is giving you the run-around. Make sure to report her to the BBB, and anyone else you can report her to, so others don't end up in the same unfortunate situation. Good luck. |
