How do I get my wedding pictures from my unresponsive photographer? |
Considering small claims court. He will not return phone messages or email. Like another poster I would definitely use the BBB in your town as well as the Attorney General's office. When I was still in TN I was trying to close a bank account that the bank wanted to keep open for months because of bounced check nearly a year prior which was preventing me from moving my money elsewhere. The check had long since been covered and there was nothing else outstanding on the account. Until the AG's office sent them a letter they were adamant it couldn't be closed. Two days after I got a letter from the AG I got a letter from the bank saying they would issue my check in 3 days. Maybe stopping by his studio would work. Otherwise, a strong letter from an attorney might get the ball rolling before you even have to go to court. The simplest thing to do would be to contact an attorney and have him write a "demand" letter. Frequently, just knowing someone is serious enough to get a lawyer involved is all that is needed to get a problem like this solved. Try emailing him one last time with a simple request that he produces the said items within a specified time or you will have no option but to take it to small claims. Tell him you have been given this advice by a lawyer. In the meantime do call a lawyer & see what else you can do. Was there a signed agreement? If so this will make it much easier to get your photos or a refund. Also call The Department of Fair Trading. File a complaint with the better business bureau and send a letter to that Attorney General's office of your state. Also, if he listed any professional organizations on his card or in his ad, contact them and file a complaint as well. If he works with any particular venue or wedding planner, let them know how unhappy your are. Make sure you mail him copies of all the letter, along with a letter requesting EITHER, your pictures or your money back. Make sure you send it registered mail with return receipt required. If you don't get any response from that, go to small claims court. What a jerk! Quick photographer story: Friends of our got married and hired a photographer. This guys claim to fame was that he was related to some famous sports guy. Since the groom was a sports buff, they hired him. When they got his pictures....the top of the groom's head was cut off in all the pictures of him and the bride! When they complained he said (get this) "Well you can see his eyes...that's all that matters"!! Can you believe it? There are some real winners out there! Why would someone do that?? How annoying! Did you sign a contract with him and was he paid in advance? If so you should write him a letter stating that you have contacting him several times my phone and email and he has not responding to you. Tell him you need to know if there is a problem. Write in the letter that he has 10 business days to have your photographs ready or you will be forced to take legal action and one of those actions will be to contact the Better Business Bureau with a complaint of his practices.
